Nullification of Carcass Meat Regarding Carriage Defilement
Can halakhic nullification dissolve ritual carriage impurity when an entire olive-bulk of carcass meat is carried inside a mixture?
The Torah dictates that an animal carcass (נבילה - neveilah) imparts ritual impurity through direct touch (מגע - maga) and through carrying (משא - masa). When a piece of carcass meat falls into pieces of kosher slaughtered meat (שחוטה - shechuta), the majority normally nullifies the forbidden minority under the rules of majority nullification (ביטול ברוב - bitul berov).
In Bekhorot 23a, the Gemara examines whether nullification removes both types of impurity. While touching the mixture may be deemed pure because one does not definitely touch the forbidden piece, lifting the entire mixture means carrying the full forbidden measure.
This raises a fundamental question: does bitul berov physically and legally transform the identity of the carcass meat, or does it merely obscure its identity for individual interactions?
The question
Does majority nullification eliminate the impurity of carrying (טומאת משא), or does lifting the whole mixture impart impurity because the physical carcass meat is still carried?
Through the sources
The Gemara (Gemara)
נְהִי דִּבְמַגָּע לָא מְטַמֵּא, לְטַמֵּא בְּמַשָּׂא!Abaye challenges the notion that nullification leaves impurity present, noting Rav Chisda's ruling that carcass meat is nullified in slaughtered meat; yet if the impurity remains, it should defile through carrying.
The Gemara (Gemara)
Rav Dimi resolves this by citing Rabbi Chiyya and Rabbi Yosei bar Rabbi Chanina: nullification renders the mixture pure regarding contact, but it defiles through carrying.
Rashi (Rishonim)
Rashi explains that contact does not defile because we do not assume the person touched the carcass meat, whereas lifting the batch means the person carried the impurity.
Rabbeinu Gershom (Rishonim)
Rabbeinu Gershom emphasizes that if nullified impurity is considered present, carrying must defile because the impurity is considered present in the transported load.
Tosafot (Rishonim)
Tosafot explain that masa defiles only when an intact olive-bulk exists; biblically it was nullified, but the Sages decreed impurity because ultimately he carries an olive-bulk.
Tosafot on Menachot (Rishonim)
Tosafot cross-reference our sugya to confirm that nullification of carcass meat in slaughtered meat applies to contact but not carrying.
Piskei Tosafot (Halacha)
Piskei Tosafot summarize the ruling succinctly: carcass meat is nullified in slaughtered meat regarding contact, and not through carrying.
Ways to understand it
Probabilistic Touch versus Inevitable Transport
Nullification regarding contact functions because of statistical uncertainty; the person likely touches only the majority pieces. In contrast, lifting the entire mixture transports the physical carcass piece without doubt, so the impurity is considered present.
Rabbinic Stringency on Gross Volume
Biblically, majority nullification fully dissolves the status of the carcass meat for both contact and carrying. Nevertheless, the Rabbis instituted a decree on carriage because a full measure was moved all at once.
Where it lands
The sugya concludes according to Rabbi Chiyya and Rabbi Yosei bar Rabbi Chanina: carcass meat mixed into slaughtered meat does not defile by contact, but continues to defile by carrying. As formulated by Piskei Tosafot, nullification operates regarding contact and not through carrying. Carrying the entire mixture inevitably moves an intact olive-bulk of impurity, sustaining the carriage defilement.
Majority nullification shields against defilement by touch, but one who transports the entire mixture remains impure through carriage.
