Nullification, Carrying, and Decay on Bekhorot 23
How Tosafot resolves questions regarding reviving impurity, the mechanics of swallowing versus carrying, and the definition of light defilement.
Intentional Nullification and the Unknowing Transgressor
The Gemara discusses whether ritual impurity that was previously nullified can return and awaken if it encounters more of its own kind. In this context, Ulla explains a rabbinic decree on a mixture of pure produce containing a trace of nullified impure תְּרוּמָה (priestly tithe). The Sages forbade wetting the mixture lest a person take a קַב (a measure of volume) of impure produce and deliberately mix it with this produce, thinking he can nullify the impurity in the majority.
Tosafot is troubled by Ulla's explanation. The law states that אֵין מְבַטְּלִין אִיסּוּר לְכַתְּחִלָּה (one may not intentionally nullify a forbidden substance). If intentional nullification is strictly forbidden by rabbinic law, why would Ulla suspect someone of planning such an action?
Tosafot answers that one who mistakenly assumes nullification is permitted is considered an unintentional transgressor. A person might erroneously believe that diluting impure non-sacred food is completely valid. According to the halachic authority who permits unintentional nullification after the fact, the Sages needed to enact a decree to prevent this common mistake.
תימה מה יועיל הא אין מבטלין [איסור] לכתחלהThis is astounding: what would it avail, given that one may not nullify forbidden matter intentionally? (Tosafot on Bekhorot 23a:1:1)
Swallowing Versus Carrying a Nullified Carcass
The Gemara evaluates how בִּיטּוּל בְּרוֹב (nullification in a majority) functions when carcass meat mixes with slaughtered meat. Rabbi Yosei bar Rabbi Chanina states that the carcass is nullified regarding מַגָּע (contact impurity), but it still imparts impurity through מַשָּׂא (carrying). Rashi explains that contact does not defile because we assume a person touched the majority of slaughtered meat.
Tosafot asks why nullification fails for carrying, yet successfully removes the biblical prohibition against eating the carcass. If a person carries the mixture, he defiles because he physically bears a whole כְּזַיִת (olive-bulk) of carcass. Why, then, is one who eats a כְּזַיִת of this mixture exempt from lashes?
Tosafot explains that eating operates differently from carrying. When carrying, an entire olive-bulk is lifted at a single moment. Regarding eating, each microscopic particle is nullified progressively upon swallowing as it enters the gullet surrounded by permitted food.
לענין אכילה כל משהו ומשהו כשנכנס בבית הבליעה קמא קמא בטל ברוב היתרRegarding eating, every tiny bit as it enters the gullet, each bit as it comes is nullified in the majority of permitted matter. (Tosafot on Bekhorot 23a:5:1)
Redefining Light and Severe Carcass Impurity
The Gemara examines Bar Padda's rule regarding decomposed carcasses. Bar Padda teaches that טוּמְאָה חֲמוּרָה (severe impurity) persists until the carcass is unfit for a גֵּר תּוֹשָׁב (resident alien), while טוּמְאָה קַלָּה (light impurity) persists until it is unfit for a dog,. Rashi defines severe impurity as carrying and light impurity as contact,.
Tosafot rejects Rashi's interpretation. The Torah explicitly links the halachic status of a carcass to its edibility for a resident alien. Once decomposed past that point, it loses the status of a carcass entirely, which eliminates carcass impurity for contact and carrying alike.
Instead, Tosafot demonstrates that all carcass impurity is categorized as severe impurity. Light impurity refers specifically to טומאת אוכלין (impurity of foodstuffs), which can impart defilement to other foods until it spoils beyond canine consumption.
כל טומאת נבילה בין מגע בין משא קורא טומאה חמורה והוא עד לגרAny carcass impurity, whether contact or carrying, is called severe impurity, and it persists until unfit for a resident alien. (Tosafot on Bekhorot 23a:8:3)
Halachic nullification depends on physical mechanics—whether an object is lifted intact or swallowed gradually—while scriptural categories define the intrinsic scope of defilement.
