Safeguarding Doubtful Teruma and the Promise of Elijah

When sanctified produce enters a state of doubtful ritual impurity, the Tannaim dispute whether the duty of protection still applies.

The Case of the Suspended Barrel

Biblical law obligates Israelites to separate תרומה (teruma - priestly gift) for the kohanim. Pure teruma must be carefully guarded from defilement, whereas produce that is definitely impure may be burned.

The Mishnah addresses a barrel of teruma that develops a ספק טומאה (uncertainty regarding ritual impurity). This produce becomes תרומה תלויה (teruma in abeyance), suspended between categories: it is forbidden to consume, yet cannot be burned.

The Tannaim dispute what one may do with this barrel. Rabbi Eliezer rules that the owner must actively safeguard doubtful teruma, moving it from a vulnerable position into a concealed location. Rabbi Yehoshua permits deliberately exposing it to potential defilement, while Rabban Gamliel rules that one must leave it untouched.

In the case of a barrel of teruma with regard to which uncertainty developed concerning its status of ritual impurity, Rabbi Eliezer says: If it was resting in a vulnerable location, one should place it in a concealed location. (Bekhorot 33b:8)

The Proposed Scriptural Debate

The Gemara initially attempts to ground this dispute in a hermeneutical debate over the verse: 'And I, behold, I have given you the charge of My terumot' (Numbers 18:8). The Amora Shmuel suggests that Rabbi Eliezer reads the plural vocalization, teaching that both pure and doubtful teruma require protection.

Under this explanation, Rabbi Eliezer holds that יש אם למקרא (the vocalization is authoritative),. Rabbi Yehoshua instead follows the singular written spelling, holding that יש אם למסורת (the written tradition is authoritative) and protecting only pure teruma,.

The Gemara rejects this correlation based on a baraita regarding a Hebrew maidservant. There, Rabbi Eliezer derives the law from the defective spelling of the text, demonstrating that in truth the written tradition is authoritative according to him,.

The True Sevara: Anticipating Elijah

Having rejected the textual proof, the Gemara establishes the dispute upon a conceptual debate over the word 'to you' in the same verse,.

Rabbi Yehoshua contends that safeguarding applies strictly to teruma that is currently edible and fit for consumption,. Because doubtful teruma cannot be eaten, it does not require safeguarding.

Rabbi Eliezer counters that doubtful teruma is still deemed fit for use. He argues that Elijah the Prophet might arrive to clarify the factual doubt and declare the food pure,. Because it possesses potential edibility, one remains obligated to guard it from definite contamination.

Rabbi Yehoshua holds: That which is fit for you, safeguard; but that which is not fit for you, do not safeguard. And Rabbi Eliezer holds: This is also considered fit, because perhaps Elijah will come and deem it ritually pure. (Bekhorot 34a:6)

The Practical Halachic Ruling

This machloket determines whether objects of latent or doubtful sanctity retain their protective obligations. Does an unverified status strip sanctified food of its standing, or does the prospect of clarification preserve its sanctity?

The halacha is decided in accordance with the middle ruling of Rabban Gamliel.

Consequently, an individual is forbidden to actively defile doubtful teruma with one's hands, but one is not required to actively shield it from indirect ruin.

While Rabbi Eliezer guards doubtful teruma because Elijah might verify its purity and Rabbi Yehoshua permits exposing it, the halacha follows Rabban Gamliel to leave it entirely untouched.
