Status of Tumtum: Concealed Gender Versus Distinct Creature
Is a person or animal with concealed genitalia merely a normal male or female hidden from view, or an entirely distinct category of existence?
The Mishnah and Gemara discuss whether a טומטום (tumtum, an individual whose sex organs are concealed by a layer of skin) has firstborn sanctity. Rav Chisda asserts that all agree a טומטום is fundamentally an ordinary male or female whose identity is merely obscured.
Rava immediately challenges this position from various baraitot that exclude both an אַנְדְּרוֹגִינוֹס (androgynos, hermaphrodite) and a טומטום from Torah laws like ערכין (arakhin, valuations) and offerings. The Gemara repeatedly answers by emending the baraitot to omit the טומטום.
Eventually, the Gemara examines whether tannaitic disputes view a טומטום as a בריה בפני עצמה (beriah bifnei atzmah, an independent entity) or strictly a case of ספק (safek, doubt) between male and female.
The question
Is a טומטום inherently an ordinary male or female afflicted with concealed anatomy, or does the Torah classify it as a unique, independent gender entity?
Through the sources
The Gemara (Gemara)
Rav Chisda establishes that a טומטום is sacred due to doubt, because it possesses a definite male or female anatomy beneath the concealing flesh.
The Gemara (Gemara)
The Gemara concludes that no authority considers a טומטום to be an independent creature, but rather a doubt of male or female.
Rashi (Rishonim)
Rashi explains the challenge against Rav Chisda: Scripture would not exclude an individual merely out of factual doubt, since no doubt exists before Heaven.
Tosafot (Rishonim)
Tosafot explain that because a male טומטום is anatomically normal beneath the flesh, the Torah cannot exclude it as an abnormality.
Chiddushei Ramban (Rishonim)
Ramban demonstrates from our sugya that the classification בריה בפני עצמה is uniquely deployed to negate ordinary factual doubt.
Ways to understand it
Concealed Binary Gender
A טומטום is completely normal internally, possessing standard male or female reproductive anatomy. The doubt is merely human ignorance caused by an external covering of skin, meaning it never constitutes a distinct creature.
Ontological Distinct Entity
The initial hava amina suggested that because the Torah repeatedly excludes טומטום alongside an אַנְדְּרוֹגִינוֹס, its altered state makes it a third gender category altogether.
Where it lands
The Gemara firmly rejects the theory that a טומטום is a בריה בפני עצמה, ruling that it is strictly an unresolved doubt between male and female. In animals, urination tests can often resolve this doubt, whereas in humans the condition remains a halachic doubt unless surgically torn open. Consequently, a human טומטום is subject to stringencies of both genders, requiring ḥalitza and taking effect in marriage due to unresolved binary uncertainty.
A טומטום is not an alternative gender, but an ordinary male or female hidden beneath the skin.
