Before you learn Bekhorot 52
Where we left off
The Mishnah restricted claims on post-mortem estate appreciation and uncollected assets. The Gemara now begins analyzing the biblical sources and limits for these rules.
The question going in
Which heirs and claimants are excluded from uncollected property and post-mortem estate appreciation, and why?
Know before you start
- שבח (estate enhancement): This is the increase in estate value occurring after the owner's death,. A firstborn does not receive a double portion in this enhancement.
- ראוי (prospective property): These are assets due to the deceased that were not yet in his possession at death. A firstborn cannot claim a double portion from them.
- יובל (Jubilee Year): In the fiftieth year, sold ancestral lands return to their original owners,. The Sages debate whether gifts and inheritances must also return.
Who's who
- Abaye (אביי, Amora): He holds that a yavam collects property enhancements accrued between levirate marriage and estate division.
- Rava (רבא, Amora): He holds that a yavam cannot take any enhancement occurring prior to estate division.
- Rabbi Meir (רבי מאיר, Tanna): He rules that gifts, primogeniture portions, and spousal inheritances do not return in the Jubilee.
- Rabbi Elazar (רבי אלעזר, Tanna): He rules that all these contested land transfers must return in the Jubilee Year.
