Ishto Kegufo in Ritual Testimony

In ritual prohibitions, one witness is usually believed, yet a wife cannot testify for her husband. Bekhorot 35b examines whether this exclusion stems from suspicion of shared bias or a complete legal identification.

A בכור (firstborn male animal) belonging to a כהן (priest) is consecrated from birth. It may only be slaughtered and eaten if it develops a permanent blemish naturally. The Sages suspected priests of intentionally inflicting blemishes because maintaining an unblemished animal creates a heavy burden of upkeep.

Because of this suspicion, a כהן is not believed to testify about his own animal. However, the Gemara establishes that another כהן or even the owner's children may testify that the blemish occurred naturally.

Yet the Gemara explicitly disqualifies the owner's wife from testifying. It justifies this exclusion with the principle that a wife is considered like himself.

The question

Is the disqualification of a wife an intensified form of bias and suspicion, or does it reflect a formal legal identity that negates her status as a witness?

Through the sources

The Gemara (Gemara)

The Gemara accepts the ruling of Rabban Shimon ben Gamliel regarding children. However, it bars the wife because she is as himself.

Rash MiShantz (Rishonim)

A glossator on the Rash notes that the disqualification in Bekhorot is based purely on suspicion of leniency rather than an absolute biblical decree.

Mishneh Torah (Halacha)

The Rambam rules that children are believed because one does not sin for another. Yet the wife cannot testify because she is as his own person.

Tur (Halacha)

The Tur rules that even a single witness is sufficient for blemishes. Still, the wife remains excluded as his body.

Tzafnat Pa'neach (Acharonim)

The Rogatchover analyzes whether the wife is disqualified due to an enactment of personal suspicion or because she forms a single physical entity with him.

Kaf HaChayim (Acharonim)

Citing the Olat Yitzchak, he notes that Bekhorot is unique due to the severe financial burden, which makes both the husband and his wife suspect.

Ways to understand it

Heightened Practical Suspicion

The wife manages the home and directly suffers the financial strain of raising the animal. Her disqualification is due to heightened practical suspicion of collusion rather than an intrinsic lack of testimony status.

Ontological Bodily Identity

Marriage establishes a legal state where husband and wife are one entity. Since a person cannot testify for himself, her testimony ceases to exist under ontological legal identity.

Where it lands

The halacha follows the conclusion of the Gemara as codified by the Rambam and the Tur. In ritual matters where relatives are normally deemed credible, the wife remains uniquely disqualified. She cannot serve as an independent witness for her husband's firstborn.

Even where the Torah trusts relatives, a wife cannot testify for her husband because halacha views them as one and the same person.
