Where we left off
The previous daf finished examining firstborn status for caesarean births. A completely new sugya begins here on our daf.
The question going in
When twin sons have uncertain birth order, can a priest collect redemption money from their father's estate?
Know before you start
- פדיון הבן (Redemption of the firstborn): A father must redeem his male firstborn from a priest for five sela coins. This obligation takes effect after thirty days have passed from birth.
- מלוה על פה (Oral loan): Torah obligations like redemption are treated like an oral loan. A creditor collects an oral loan from heirs, but not from purchasers.
- האחין שחלקו (Brothers who divided an estate): When brothers divide an inherited estate, their legal status comes into question. Under one view, they are considered half heirs and half purchasers from each other.
Who's who
- Rabbi Meir (רבי מאיר, Tanna): He holds that sons of uncertain birth order are exempt after dividing their father's estate.
- Rabbi Yehuda (רבי יהודה, Tanna): He holds the father's property remains obligated to the priest even after the sons divide.
- Rabbi Yirmeya (רבי ירמיה, Amora): He compares undivided brothers to partners sharing property against whom a creditor can collect.
- Rava (רבא, Amora): He explains that the Tannaitic dispute concerns collecting partial redemption money from the estate.
