Before you learn Bekhorot 49
Where we left off
The Gemara asked how two fathers can reclaim five sela from a single priest. Shmuel begins resolving this problem as the daf opens.
The question going in
How can fathers legally recover redemption money, and when does the obligation of redemption take effect?
Know before you start
- הרשאה (authorization / power of attorney): A document giving one person legal power to collect another's property. The Rabbis restrict writing authorization over movable items if the respondent denied the claim.
- שני כתובים הבאים כאחד (two verses that teach one principle): When the Torah repeats the same law in two places, they cannot teach that rule elsewhere. The Gemara debates whether this rule applies when both passages discuss the exact same subject.
- מלוה הכתובה בתורה (a loan written in the Torah): This refers to a monetary obligation imposed directly by biblical command. The Sages debate whether it functions like a signed contract that collects from liened property.
- מנה צורי (Tyrian maneh): A currency standard with high silver content. Fixed Torah payments, like redemption of a firstborn, must be paid using this standard.
Who's who
- Shmuel (שמואל, Amora): Rules that an early redemption fails if the priest consumed the coins before day thirty.
- Rav (רב, Amora): Holds that early redemption takes effect after thirty days even if the money was consumed.
- Rabbi Akiva (רבי עקיבא, Tanna): Considers death on the thirtieth day an unresolved doubt regarding the obligation of redemption.
- Rabbi Yehuda (רבי יהודה, Tanna): Prioritizes redeeming the son over the father, because biblical debts collect from liened property.
